Legal basis of the contest "vistoporelmundolanzamarathon"

Identification of the organizing company

The company Sands Beach Resort with registered office at Avenida Islas Canarias 18 and with CIF B76218908 has organized this campaign entitled #vistoporelmundolanzamarathon.

Start and end dates of the contest and geographic scope

The contest start date will be February 15, 2019 at 09:00 hours and end on October 31, 2019 at 23:59 hours. You can participate only in that period of time.

The campaign is aimed at users at the International level. There is a possibility to cancel the draw. Sands Beach Active reserves the right to postpone or extend the period of the contest in case of force majeure, as well as the power to interpret these terms and legal conditions.

Rules and conditions to participate

Individuals over 18 years of age residing all over the world may participate in the contest. Employees of the company, fraudulent profiles or experts in contests may not participate.

To participate they must:

• Take a photo with the #lanzamarathon finisher shirt of any edition.
• Upload the photo to instagram, Facebook or Twitter.
• Tag us #vistoporelmundolanzamarathon (national) or #seenaroundtheworldlanzamarathon (international)

The publications that exceed the 300 likes will enter the draw for 3 nights of stay with breakfast at Sands Beach Resort + a free registration for any of the distances.

Sands Beach Active reserves the right to make changes to the campaign during its development, if there is any cause that prevents it from running smoothly or in order to improve its progress.

Selection of the winner and draw mode

The draw will take place on November 1 at 10:00 hours. There will be a raffle among all the participants before a notary where a single winner will be chosen. The winner will be officially announced on our fan page and we will send you a personal email. If within 7 days you have not responded, the award will go to the substitute, who will also have 7 days to respond. Once the prize is offered to the substitute, the previous winner will lose the right to claim the prize.

Sands Beach Active is exempt from any liability in case of any error in the data provided by the winners / substitutes that prevents its identification.

Value and nature of the prize offered

The prize will be a stay of 3 nights for 2 people with breakfast included, whose approximate value is 120 euros + a free registration to the marathon (€ 65) half marathon (€ 45) or 10km (€ 30). You can enjoy this award at Sands Beach Resort and Font Vella Lanzarote International Marathon presenting the bonus that guarantees that you have been the winner of our contest and that we will send you an attachment by email.

Sands Beach Active is not responsible for any loss, damage, theft or any other circumstance attributable to the messaging services that may affect the sending of the prizes.

Personal data protection

The data provided by the participants will be treated confidentially and collected in an automated file of personal data, with the Sands Beach Active company being the owner and responsible for said file, with the aim of:

• Manage the participation of the contestants and get in touch with them.
• Communicate to them that they have been winners of the contest.

Sands Beach Active guarantees full compliance with Organic Law 15/1999, of December 13, on the Protection of Personal Data in the processing of personal data collected in the contest #vistoporelmundolanzamarathon, especially regarding the attention of the exercise of the rights of information, access, rectification, opposition and cancellation of personal data of the contestants.

Penalties in case of fraudulent use

We will understand as fraud the use of platforms or independent applications to obtain votes or more participations in the contest, as well as behaviors that we detect as apparently abusive and / or malicious.

The verification of any of these practices will result in the disqualification of the contest / annulment of the votes or participations that we believe have arrived through channels not allowed in the campaign.

Sands Beach Active reserves the right to take legal action against those persons who perform any type of act likely to be considered as manipulation or forgery of the contest.

Sands Beach Active is exempt from any liability for damages that may be due to temporary lack of availability or continuity of operation of the application through which you participate in the promotion, to the fraud of the utility that the users could have attributed to it and to the access to the different pages and deliveries of participation responses through the Internet.

Transfer of image rights and / or intellectual property

The participants and winners will transfer the exploitation rights of their photographs / videos to the company Sands Beach Active for the contest #vistoporelmundolanzamarathon during a calendar year in the national territory. In the case of participating with a photograph / video that contains the image of a person, the person photographed must have granted their express and unequivocal consent for this purpose to the participant who has uploaded said photo / video to the contest. If the contest publicly displayed the photograph that contains the image of a person, either on the Internet or in a public exhibition, Sands Beach Active would be communicating the personal data of the image of the person photographed. Therefore, and in accordance with the LOPD and its Regulations, the prior consent of the person being photographed is mandatory. Otherwise, it could constitute a serious infringement of the LOPD with the possible penalty of a fine of 40,001 to 300,000 euros by the Spanish Agency for Data Protection. Legal terms and conditions This contest is not linked to any platform or social network Facebook, Twitter or Instagram do not sponsor, endorse or administer this promotion in any way, nor is associated with it. The participant is providing their information and data to Sands Beach Active and not to Facebook, Twitter or Instagram. Acceptance of the Legal Bases Participation in the contest implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, Sands Beach Active will be released from compliance with the obligation contracted with this participant.
